WE ARE READY TO HELP
Bad things can and do happen to good people. At this difficult time in your life you may be confused, frightened and embarrassed. You are probably wondering what will happen next and what you should do now. Hopefully this site will answer some of your questions and provide some of the knowledge you will need in your search for a qualified attorney.
do not assume your case is hopeless
It is important to remember that an arrest for Driving While Intoxicated (DWI / DUI) does not mean you are a criminal a drunk or a bad person. More people are falsely accused and convicted of DWI than any other crime. The subjective opinion of a single police officer is all it takes for an innocent person to find himself handcuffed in the back of a squad car.
DWI punishment is increasingly severe. You must take immediate action to protect your rights. If you failed or refused to take a breath / blood test, the state has already begun the process to take away your driver's license. It is in your best interest to consult with an experienced DWI lawyer as soon as possible.
A single DWI arrest may result in three separate and distinct cases: (a) the criminal charge will be litigated in the criminal court; (b) the administrative license revocation (ALR) proceeding wherein the state will seek suspension of your driver's license; and (c) in the event your license is suspended, you may file a civil case requesting an occupational driver's license which will allow you to drive to and from work, school and in the performance of necessary household duties during the period of suspension.
The Crime of Driving while intoxicated
A person commits an offense if the person is intoxicated while operating a motor vehicle in a public place.
(a) not having the normal use of mental or physical faculties by reason of the introduction of alcohol, a controlled substance, a drug, a dangerous drug, a combination of two or more of those substances, or any other substance into the body; or
(b) having an alcohol concentration of .08 or more.
"Alcohol Concentration" means the number of grams of alcohol per:
(a) 210 liters of breath;
(b) 100 milliliters of blood; or
(c) 67 milliliters of urine.
